Terms of Service

1. Eligibility and authority

You must be at least 18 years old, or the age of legal majority where you live, to create an account. If you use the Service for an organization, you confirm that you have authority to bind that organization to these Terms. You may not use the Service if applicable law prohibits you from doing so.

2. Your account

You must provide accurate information, keep your sign-in credentials secure, and promptly tell us about suspected unauthorized access. You are responsible for activity under your account and for maintaining an email address where we can reach you. You may not share access in a way that bypasses limits or security controls.

3. The Service

Formyfox lets you build and publish forms, collect and review responses, receive uploads, use AI-generated follow-up questions, and connect supported scheduling, calendar, meeting, storage, authentication, and payment services. We may improve, change, add, or remove features over time. We do not promise that every feature will always be available or that the Service will be uninterrupted or error-free.

4. Forms and respondents

You control the forms you create, the information you request, who receives access, and how you use responses. You are responsible for providing any notices and obtaining any consents required by privacy, marketing, employment, health, education, consumer-protection, or other applicable laws.

Do not request sensitive information unless it is necessary, lawful, and appropriate for the Service. You must respond to valid requests from form respondents concerning their information. Formyfox may assist you as required by applicable data-protection law.

5. Your content

You retain ownership of forms, responses, files, and other content you or your respondents submit to the Service (“Your Content”). You grant formyfox a worldwide, non-exclusive license to host, copy, process, transmit, display, and otherwise use Your Content only as needed to provide, secure, support, and improve the Service and comply with law.

You confirm that you have the rights and permissions needed for Your Content and our processing of it. You are responsible for keeping any copies you need and for configuring access to published forms appropriately.

6. Acceptable use

You may not use the Service to:

• Break the law, violate another person’s rights, or collect information without a lawful basis.
• Upload malware or content that is fraudulent, deceptive, abusive, hateful, sexually exploitative, or otherwise unlawful.
• Send spam, phishing, or unsolicited messages, or impersonate another person or organization.
• Probe, scan, disrupt, overload, reverse engineer, or bypass security or access controls, except where law expressly permits it.
• Use automated means to scrape the Service or create accounts at scale without our written permission.
• Resell, sublicense, or provide the Service as a stand-alone product without our written permission.

7. Connected services

The Service can connect with third-party services such as Google, Calendly, and Stripe, and uses OpenAI to generate AI chat follow-up questions. Your use of connected services is governed by their own terms and privacy policies. You authorize formyfox to exchange information with a connected service and take actions you request through the connection. You are responsible for your third-party accounts and may disconnect supported integrations at any time.

We are not responsible for a third-party service, its availability, or changes it makes. Removing a connection may prevent related features from working and may not remove information already held by the third party.

8. Paid features and billing

Some features require a paid subscription. Prices, billing periods, included features, and applicable taxes are shown before purchase. By starting a subscription, you authorize Stripe and formyfox to charge the payment method you provide on a recurring basis until you cancel.

You can manage or cancel your subscription through the billing portal. Cancellation takes effect at the end of the current paid billing period unless stated otherwise. Payments are non-refundable except where required by law or expressly stated at purchase. We may change future prices or included features by giving notice required by law; a price change will not apply before your next renewal after the notice takes effect.

9. Intellectual property

The Service, including its software, design, branding, and documentation, belongs to formyfox and its licensors and is protected by intellectual-property laws. These Terms give you a limited, non-exclusive, non-transferable, revocable right to use the Service as intended. They do not transfer ownership of the Service or allow you to use formyfox names, logos, or trademarks without permission.

If you provide feedback, you allow us to use it without restriction or compensation, but you do not have to provide feedback.

10. Privacy

Our Privacy Policy explains how we handle personal information. You agree that formyfox may process information as described there and as needed to provide the Service.

11. Suspension and termination

You may stop using the Service at any time. You may contact us to request account deletion. We may limit, suspend, or terminate access if you materially breach these Terms, create risk or legal exposure, fail to pay amounts due, or use the Service in a way that could harm respondents, other users, third parties, or the Service. When reasonably possible, we will give notice and an opportunity to fix the issue.

After termination, your right to use the Service ends. Provisions that by their nature should survive will remain in effect, including provisions about ownership, payment obligations, disclaimers, liability, and disputes.

12. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” Formyfox disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will meet every requirement, preserve every item of data, or be uninterrupted, secure, or error-free. Nothing in these Terms limits warranties or rights that cannot legally be excluded.

13. Limitation of liability

To the fullest extent permitted by law, formyfox and its affiliates, officers, employees, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, use, or data, arising from the Service or these Terms.

To the fullest extent permitted by law, our total liability for all claims arising from the Service or these Terms will not exceed the greater of the amount you paid to formyfox for the Service during the 12 months before the event giving rise to the claim or US $100. These limits do not apply where liability cannot legally be limited.

14. Indemnification

If you use the Service for a business or organization, you will defend and indemnify formyfox and its affiliates, officers, employees, and suppliers against third-party claims, losses, and reasonable expenses arising from Your Content, your forms, your violation of these Terms, or your violation of another person’s rights, except to the extent caused by formyfox. This section applies only to the extent permitted by law.

15. Governing law and disputes

Mandatory consumer protections and dispute rights in your place of residence continue to apply. Otherwise, these Terms and disputes relating to them are governed by the laws, and subject to the courts, of the jurisdiction where the formyfox operator is established, without regard to conflict-of-law rules. Before filing a formal claim, each party agrees to try to resolve the dispute by contacting the other and allowing 30 days for a response.

16. Changes to these Terms

We may update these Terms as the Service or law changes. We will post the revised Terms and update the date above. If a change is material, we will provide additional notice where required. Unless law requires otherwise, continued use of the Service after revised Terms take effect means you accept them.

17. General

If part of these Terms is unenforceable, the remaining terms stay in effect. A failure to enforce a term is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a merger, reorganization, sale, or transfer of the Service. These Terms, together with the Privacy Policy and terms presented at purchase, are the entire agreement about the Service and replace earlier agreements on the same subject.
